DIGITALHEALTH TERMS OF SERVICE

By accessing or using DigitalHealth, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these Terms of Service, you may not access or use the Service.

Your use of certain features or services may be subject to additional policies, guidelines, or agreements that are incorporated into these Terms by reference.

DigitalHealth is a health data aggregation platform designed to collect, integrate, manage, and display health-related information from connected devices, applications, and services.

The Service enables users, healthcare professionals, and authorized researchers to obtain a more comprehensive view of health and wellness information.

The Service may also support approved clinical, behavioral, public health, and population health research studies. Such research activities may be subject to additional informed consent documents, institutional policies, and regulatory requirements.

By creating an account or using the Service, you represent and warrant that:

Participation in research studies conducted through DigitalHealth is voluntary unless otherwise specified by a separate agreement.

If a conflict exists between these Terms and an approved research consent document, the research consent document shall govern with respect to the applicable research study.

DigitalHealth may integrate with third-party services, including but not limited to Google services, Fitbit, Dexcom, Withings, Polar, Omron, and other health-related providers.

Your use of third-party services is governed by the terms and privacy policies of those providers.

DigitalHealth is not responsible for the availability, security, accuracy, or practices of third-party services.

DigitalHealth's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

Your use of the Service is also governed by the DigitalHealth Privacy Policy.

The Privacy Policy explains how information is collected, used, disclosed, retained, and protected. By using the Service, you acknowledge that you have reviewed and understood the Privacy Policy.

The Service and its content, including software, source code, databases, documentation, text, graphics, logos, interfaces, designs, and other materials, are owned by DigitalHealth or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted by law or by DigitalHealth, users may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any portion of the Service.

DigitalHealth employs administrative, technical, and physical safeguards designed to protect information and maintain the security of the Service.

Users are responsible for maintaining appropriate security on their devices and protecting their account credentials.

No system can guarantee absolute security. Users acknowledge and accept the inherent risks associated with electronic transmission and storage of information.

DigitalHealth is provided for informational, research, and data management purposes only.

The Service does not provide medical advice, diagnosis, treatment, or emergency services.

Information displayed through the Service should not be relied upon as a substitute for professional medical advice. Users should consult qualified healthcare professionals regarding medical conditions, treatment decisions, or medical emergencies.

DigitalHealth may suspend or terminate access to the Service if a user violates these Terms, compromises security, engages in unlawful activity, or otherwise creates risk to the Service or its users.

Users may request account closure at any time.

Account termination does not necessarily result in immediate deletion of information. Retention and deletion of information are governed by the DigitalHealth Privacy Policy and any applicable research consent documentation.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by law, DigitalHealth disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

DigitalHealth does not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.

To the maximum extent permitted by applicable law, DigitalHealth, its affiliates, employees, agents, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the use of the Service.

Where liability cannot be excluded by law, liability shall be limited to the fullest extent permitted by applicable law.

DigitalHealth may update these Terms of Service from time to time.

If material changes are made, DigitalHealth will provide reasonable notice through the Service, by email, or through other appropriate means before such changes become effective.

The date shown at the top of these Terms indicates the most recent revision.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida without regard to conflict of law principles.

Any legal action arising from or relating to these Terms or the Service shall be brought in a court of competent jurisdiction located in Leon County, Florida, unless otherwise required by applicable law.
